Long story short: boss hires friend to do taxes. friend charges exorbitant rate, doesn't sign as preparer, cheats like mad. Boss doesn't really understand what's going on but is happy to be doing okay on taxes. Boss inevitably gets audited. The legality of my 1099 status at work has always been questionable at best. Still, I've tolerated it because it's a very small business and nobody else is a W2 either, and because it affords me a great deal of schedule flexibility.
